CONDITIONS OF BUSINESS

 

All orders placed with a Printing Trade-house are accepted subject to the following conditions, which shall form the basis of the contract between the Printing Trade-house and the customer.   The placing of an order implies an acceptance of the Conditions of Business herein stated, and these Conditions are paramount to any proposed by the customer, which insofar as they are contradictory to these present, are hereby excluded.   These terms and conditions supersede those printed in any previous list and all contracts entered into on and after 1st January 1983.

 

 

1.         Terms  -  A period of 30 days from date of the relevant statement is allowed for payment in respect of approved credit accounts.

            All other work is accepted on the basis of cash against delivery.

 

2.         Overdue Accounts  -  Interest at prime overdraft rates will be charged on overdue accounts.

 

3.         Alterations or Additional Work  -  Reproductions involving additional work over and above that required for average commercial work e.g. additional retouching, out-lining, make-up, superimposing of type alteration to originals, departure from original instructions etc. will result in increased charges.

 

4.         Reproduction of Originals  -  Orders for the reproduction of originals are accepted on the understanding that the customer is fully entitled to make use of such originals and that he indemnifies the Printing Trade-house from all liability for damages consequent on the reproduction.

 

5.         Lien  -  Customer’s property is held subject to a general lien with power to enforce by public or private sale without notice to customers.

 

6.         Expedited Delivery  -  Should delivery of work be required in less than the normal time requisite for its proper reproduction, every effort will be made to secure freedom from defects but reasonable allowance shall be made by customers in such cases.   Extra charge is made if sufficient time is not allowed for all work to be done during ordinary working hours.

 

7.         Claims  -  Any complaint must be made within 7 days of delivery, beyond which period no claim will be entertained.

 

8.         Insurance  -  While every care and precaution is taken against loss of, or damage to originals and all articles entrusted to the Printing Trade-house, no liability is accepted should damage or loss occur.   Customers are urged to insure their property.

 

9.         Negatives or Positives  -  Colour separated continuous-tone negatives, and all preparatory material remain the sole property of the Printing Trade-house who gives no guarantee that they will be available at any future time for re-use.  The Printing Trade-house undertakes, however, not to utilize any Colour separated continuous-tone negatives and all preparatory material in their possession for the purpose of doing work for a third party without the consent of the customer concerned.

 

10.       Storage of Positives  -  Customers are required to accept delivery of positives and litho plates immediately these are completed unless arrangements to the contrary are made in writing.   Printing Trade-houses are in no case to be liable for any loss or damage to positives and litho plates left in their possession unless the customer  has given written instructions requiring such related material to be retained and has paid a storage charge including any charge for insurance.

 

11.       Consequential Loss or Damage  -  No responsibility or any liability whatsoever is accepted by the Printing Trade-house for direct or consequential loss or damage of any nature, including any loss to the customer arising from third party claims occasioned by errors in carrying out work or by delay in delivery.

 

12.       Colour Reproduction  -  Where for any reason proofs in colour are not ordered, colour register and colour values cannot be guaranteed.  Any subsequent correction of register or colour value is charged extra according to the time taken.

 

13.       General Materials  -  All original material including blocks and moulds shall remain the property of the Printing Trade-house unless specific prior agreement has been agreed upon.

 

14.       Preliminary Work  -  Work produced whether experiment or otherwise, at customer’s request will be charged for.

 

15.       These charges are based on normal hours of work, i.e. from 8 a.m.  to  6 p.m., Monday to Friday.   Work performed outside these hours at the customer’s request involves extra cost which will be charged for at current rates.

 

16.       Acceptance  -  The placing of an order with the Printing Trade-house implies an acceptance of the Conditions of Business stated herein.

 

17.       Illegal Matter  -  (a)  The Printing Trade-house shall not be required to produce any matter which in his opinion is or may be of an illegal or defamatory nature.

            (b)  The Printing Trade-house shall be indemnified by the customer in respect of any claim, costs and expenses arising out of any illegal or defamatory matter printed for the customer or any infringement of copyright, patent or design.

 

 

18.       Any Quotation or Estimate  -  is subject to confirmation on receipt of order, and to the goods referred to being available for the execution of order when received.   Any price quoted is subject to withdrawal at any time until the order is accepted or confirmed.   Time for delivery is stated as accurately as possible.

 

19.       Stripping and Overprinting  -  will be charged for on a time and material basis at the current rates.

 

20.       Legal Costs and Jurisdiction  -  In the event of legal action having to be instituted to recover any amounts due from the customer, the customer shall be liable for costs as between attorney and client including collection commission at the rate as laid down by the Law Society. 

            In the event of legal action having to be instituted the customer consents to the jurisdiction of the relevant magistrates court.

 

 

Every effort is made to see that material supplied by this Company is produced correctly and in accordance with instructions received.

 

However, it is advisable that FINAL MATERIAL be CHECKED BY YOU, as our liability in case of error is limited to correction and replacement of the material we have supplied.
